Can you deduct your rent as a business expense? As with most tax questions, the answer is \u201cYes, but\u2026\u201d.&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black\"><strong>Since the 2024 tax year (i.e. for 2023 income), the deduction of rent as a business expense is subject to new conditions. You now need to provide some mandatory information by adding an annex to your tax return. In this article, we explain how to do this.<\/strong><\/p>\n\n\n\n<h2 id=\"can-you-deduct-your-rent-as-a-business-expense\" class=\"wp-block-heading font-degular scroll-mt-32\"><strong>Can you deduct your rent as a business expense?<\/strong><\/h2>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black\">Whether you\u2019re self-employed in a main or secondary occupation, you have every right to deduct your rent as a business expense. That said,&nbsp;<strong>it\u2019s unlikely your landlord will allow you to do so.<\/strong><\/p>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black\"><em>Excuse me?!<\/em><\/p>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black\">Yes, you read that right. If you deduct your rent as an expense, this impacts&nbsp;<strong>the way your landlord is taxed.<\/strong>&nbsp;For the rental of a private home,&nbsp;<strong>the landlord is taxed on the indexed cadastral income <\/strong>(\u2018revenue cadastral\u2019 (RC) \/ \u2018kadastrale inkomen\u2019 (KI))&nbsp;of the property, which is essentially a fictitious annual net rental value for the property, established by the government. The owner of a property that is used (partially) professionally is taxed on the&nbsp;<strong>actual rental income.<\/strong> In other words, they have to pay&nbsp;<strong>more taxes<\/strong>&nbsp;on rental income in the latter case.<\/p>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black\">If your landlord still allows you to use the\u00a0<strong>property for business purposes,<\/strong> you can\u00a0<strong><a class=\"font-inter text-purple underline underline-offset-1\" href=\"https:\/\/www.accountable.eu\/en-be\/blog\/deduct-housing\/\">deduct your rent as a business expense<\/a><\/strong> provided you meet\u00a0<strong>a few strict conditions.<\/strong><\/p>\n\n\n\n<h3 id=\"conditions-for-deducting-your-rental-costs\" class=\"wp-block-heading font-degular scroll-mt-32\"><strong>Conditions for deducting your rental costs<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list list-disc list-outside ml-0 mb-4 space-y-2\">\n<li class=\"font-inter text-base text-black\">Your\u00a0<strong>landlord<\/strong>\u00a0must be aware of your\u00a0<strong><a class=\"font-inter text-purple underline underline-offset-1\" href=\"https:\/\/www.accountable.eu\/en-be\/blog\/main-or-secondary-occupation\/\">self-employed activity, whether it\u2019s your main or secondary occupation<\/a>,<\/strong>\u00a0and\u00a0<strong>accept<\/strong>\u00a0that you carry it out (partially) from their property.<\/li>\n\n\n\n<li class=\"font-inter text-base text-black\">The rental contract must clearly indicate the\u00a0<strong>area\u00a0of the property that is destined for professional use<\/strong>\u00a0and the area that is for private use.\u00a0<\/li>\n\n\n\n<li class=\"font-inter text-base text-black\">The contract must stipulate<strong> two types of rent:<\/strong> the\u00a0<strong>rent for the professional part<\/strong>\u00a0of the property and the\u00a0<strong>rent for the private part<\/strong>. For the latter, the owner is only taxed on the cadastral income.\u00a0<\/li>\n\n\n\n<li class=\"font-inter text-base text-black\">The landlord has <strong><a class=\"font-inter text-purple underline underline-offset-1\" href=\"https:\/\/finances.belgium.be\/fr\/E-services\/MyRent\">paid for the registration of your rental contract<\/a><\/strong>\u00a0(page available in French\/Dutch\/German) within four months of its signature.<\/li>\n\n\n\n<li class=\"font-inter text-base text-black\">As a self-employed sole trader, whether in a main or secondary occupation, you have an &#8216;information obligation&#8217;. Concretely, this means you need to add the new\u00a0mandatory\u00a0<strong><a class=\"font-inter text-purple underline underline-offset-1\" href=\"https:\/\/finances.belgium.be\/fr\/experts_partenaires\/professions-economiques\/formulaires-ipp\/annexe-270-mlh\">annex 270 MLH<\/a>\u00a0to your personal income tax return <\/strong>(page available in French\/Dutch\/German). If you have a company, the same applies for your corporate tax return. We explain more about this later in this article.<\/li>\n<\/ul>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black\">Check if you meet the above conditions before deducting your rent as a business expense. This will help you avoid unnecessary conflicts with your landlord and the tax authorities.<\/p>\n\n\n\n<h2 id=\"how-to-deduct-your-rent-as-a-business-expense-in-your-accounting\" class=\"wp-block-heading font-degular scroll-mt-32\"><strong>How to deduct your rent as a business expense in your accounting<\/strong><\/h2>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black\">First things first: when you\u2019re self-employed, whether in a main or secondary occupation, you can&nbsp;<strong>never<\/strong>&nbsp;deduct&nbsp;<strong>your entire rent<\/strong>&nbsp;as a business expense.&nbsp;<strong>You can only deduct the rental costs that correspond to the part of your home used for your business.<\/strong>&nbsp;The breakdown of professional vs private use must be legally established in your rental agreement (see the second condition&nbsp;above).<\/p>\n\n\n\n<h3 id=\"what-percentage-of-your-rent-can-you-deduct\" class=\"wp-block-heading font-degular scroll-mt-32\"><strong>What percentage of your rent can you deduct?<\/strong><\/h3>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black\">The deductible area of \u200b\u200byour rented home is indicated in your registered rental agreement. This is the area of \u200b\u200bthe property that you use to carry out your self-employed activity. There\u2019s no official rule on this, but it\u2019s best to keep your&nbsp;<strong>professional use to a maximum of 15% of the total living area.<\/strong><\/p>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black\">\u26a0\ufe0f Warning: In the event of a tax audit, the tax authorities have the right to come to your home and check what percentage of the property you rent is dedicated to your work. So it\u2019s best to be honest from the start.<\/p>\n\n\n\n<h3 id=\"how-to-enter-your-rental-costs-in-your-accounting\" class=\"wp-block-heading font-degular scroll-mt-32\"><strong>How to enter your rental costs in your accounting<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list list-disc list-outside ml-0 mb-4 space-y-2\">\n<li class=\"font-inter text-base text-black\"><strong>Every month,<\/strong> keep\u00a0<strong>proof that you have paid your rent.<\/strong> If you pay the rent for the private and professional parts of the property together, indicate the separate amounts in the communication of your bank transfer. You can also create a separate overview in which you distinguish your business expenses from your private expenses.\u00a0<\/li>\n\n\n\n<li class=\"font-inter text-base text-black\">Send your\u00a0<strong>monthly payment record<\/strong>\u00a0to your accountant or upload it to your accounting software if you use a tool like\u00a0<strong><a class=\"font-inter text-purple underline underline-offset-1\" href=\"https:\/\/www.accountable.eu\/en-be\/\">Accountable<\/a>.<\/strong> Because as a self-employed sole trader, you can easily manage your accounting yourself.<\/li>\n\n\n\n<li class=\"font-inter text-base text-black\">In any case, keep all\u00a0<strong>documents:<\/strong> your rental contract, proofs of payment, and any other agreements or correspondence with your landlord. This way, you can prove that everything is in order if the tax authorities come knocking.<\/li>\n\n\n\n<li class=\"font-inter text-base text-black\">Prepare an\u00a0<strong>annual declaration<\/strong>\u00a0(the income statement) including the deductible rental costs in the appropriate category. Then you need to add this annex to your tax return.<\/strong><\/p>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black\"><strong>By introducing this new rule, the tax authorities are ensuring that owners are correctly taxed on the rental of their property. <\/strong>But let&#8217;s face it, this information obligation makes it more complicated to deduct your rent as a business expense. We&#8217;ll tell you what you need to watch out for.<\/p>\n\n\n\n<h3 id=\"how-to-deduct-your-rental-income-as-a-self-employed-sole-trader-in-your-tax-return\" class=\"wp-block-heading font-degular scroll-mt-32\"><strong>How to deduct your rental income as a self-employed sole trader in your tax return<\/strong><\/h3>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black\">There\u2019s a new section E in box XIII of your personal income tax return. If you want to deduct your rent as a business expense as a self-employed person, you need to confirm this by checking the boxes next to&nbsp;<strong>codes 1072 and 2072.<\/strong><\/p>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black\">Then, attach your completed\u00a0<strong>annex 270 MLH<\/strong>\u00a0to your tax return.<\/p>\n\n\n\n<h3 id=\"what-information-needs-to-be-included-in-the-annex-to-the-tax-return\" class=\"wp-block-heading font-degular scroll-mt-32\"><strong>What information needs to be included in the annex to the tax return?<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list list-disc list-outside ml-0 mb-4 space-y-2\">\n<li class=\"font-inter text-base text-black\">The\u00a0<strong>identification details of the tenant<\/strong>\u00a0(you): last name, first name, national register number, etc. If you have a company, you\u2019ll need to indicate the name and business number of the company.<\/li>\n\n\n\n<li class=\"font-inter text-base text-black\">The\u00a0<strong>owner&#8217;s identification details<\/strong>\u00a0and the\u00a0<strong>address<\/strong>\u00a0of the rental property for which you want to deduct rental costs.<\/li>\n\n\n\n<li class=\"font-inter text-base text-black\">The\u00a0<strong>details of the lease contract,<\/strong> such as the amount of rent paid and the portion you want to deduct for tax purposes.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"when-should-you-not-add-an-annex\" class=\"wp-block-heading font-degular scroll-mt-32\"><strong>When should you not add an annex?<\/strong><\/h3>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black\">Do you receive an&nbsp;<strong>invoice <\/strong>for renting the professional part of your home? If so, you don\u2019t need to add an annex to your tax return.
