Don\u2019t forget about taxes"},"content":{"rendered":"\n<p><strong>Are you a content creator on TikTok, living in Belgium, and you\u2019ve amassed a nice following? Is it starting to pay off? Maybe with free products to try, sponsorships from companies, or via affiliate marketing? Congratulations! Sadly, we\u2019ve got some news you probably don\u2019t want to hear\u2026 you have to declare all this income to the tax authorities. We\u2019ll also explain whether or not you\u2019ll need to register as self-employed.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Declaring gifts in your tax return<\/strong><\/h2>\n\n\n\n<p>As a content creator, if you promote a product or business on your TikTok account and receive products or services in return, you generally <strong>have to<\/strong>&nbsp;<strong>report them.<\/strong>&nbsp;This also includes products you receive without asking for them, unless you return them.<\/p>\n\n\n\n<p>If this is something that doesn&#8217;t happen regularly, you don&#8217;t need to become self-employed right away. In your tax declaration, you can mention these gifts under the category \u2018avantages de toute nature\u2019 \/ \u2018voordeel alle aard\u2019 (\u2018benefits in kind\u2019).<\/p>\n\n\n\n<p>For&nbsp;<strong>the reference value<\/strong>&nbsp;to mention in your declaration, this is&nbsp;<strong>the amount you would have paid for the item in a store.<\/strong> The company offering the gift also needs to provide you with a&nbsp;<strong>tax form.<\/strong> They can then deduct the product as a cost. With this form, you have the exact amounts and the necessary documents for your declaration.<\/p>\n\n\n\n<p>\ud83d\udca1&nbsp;<strong>Accountable tip<\/strong>: If you promote products that have been gifted to you, always follow the rules to correctly indicate&nbsp;<a href=\"https:\/\/economie.fgov.be\/fr\/themes\/ventes\/publicite\/vous-etes-createur-de-contenu\"><strong>sponsored content<\/strong><\/a>&nbsp;(page available in French\/Dutch) to avoid fines.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>How to correctly declare your TikTok income<\/strong><\/h3>\n\n\n\n<p>All income you earn as an influencer via TikTok must be&nbsp;<strong>declared to the Belgian tax authorities.<\/strong> The exact way to do so depends mainly on how much you earn with TikTok.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Occasional income<\/strong>\u00a0(limited to 1-2 times per year) can be declared in your income tax return as \u2018revenus divers\u2019 \/ \u2018diverse inkomsten\u2019 (\u2018miscellaneous income\u2019)\u00a0and is taxed at 33%.<\/li>\n\n\n\n<li>If you\u00a0<strong>earn money on a regular basis<\/strong>, you need to register as\u00a0<strong>self-employed\u00a0<\/strong><a href=\"https:\/\/www.accountable.eu\/en-be\/blog\/main-or-secondary-occupation\/\"><strong>in a main or secondary occupation.<\/strong><\/a><\/li>\n\n\n\n<li>If you\u00a0<strong>earn a lot of money<\/strong>\u00a0(more than \u20ac100,000 per year), it\u2019s better to\u00a0<a href=\"https:\/\/www.accountable.eu\/en-be\/blog\/sole-trader-to-company-when-how\/\"><strong>create a company<\/strong><\/a>.<\/li>\n<\/ul>\n\n\n\n<p>We\u2019ll look at these situations in more detail below.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Which social status should you choose as a TikToker?&nbsp;<\/strong><\/h3>\n\n\n\n<p>As soon as you&nbsp;<strong>regularly earn money online&nbsp;as an influencer,<\/strong>&nbsp;you must register as self-employed to carry out those activities. This generally involves becoming subject to VAT.&nbsp;<\/p>\n\n\n\n<p>According to the&nbsp;<a href=\"https:\/\/financien.belgium.be\/fr\/particuliers\/declaration_impot\/taux-imposition-revenus\/revenus\/influenceurs#q1\"><strong>Federal Public Service (FPS) Finance<\/strong><\/a> (page available in French\/Dutch\/German), \u2018regular\u2019 means that it\u2019s not a one-off activity but that, for example, you make daily, weekly or monthly posts of a promotional nature for which you are paid.<\/p>\n\n\n\n<p>There\u2019s&nbsp;<strong>one exception<\/strong>&nbsp;where you don\u2019t need to be a freelancer: you can take on a&nbsp;<strong>temporary assignment via a payroll service or workers&#8217; cooperative.<\/strong>&nbsp;If you choose this route, a company like&nbsp;<a href=\"https:\/\/www.liantis.be\/en\/starting-a-business-belgium-as-a-foreigner\"><strong>Liantis<\/strong><\/a>&nbsp;or&nbsp;<a href=\"https:\/\/smartbe.be\/en\/\"><strong>Smart<\/strong><\/a>&nbsp;will take care of the admin and you work under the status of employee.<\/p>\n\n\n\n<p>\ud83d\udca1&nbsp;<strong>Accountable tip<\/strong>: If you\u2019re a minor or a student and want to make money as a TikToker, take a look at this important information from&nbsp;<a href=\"https:\/\/financien.belgium.be\/fr\/particuliers\/declaration_impot\/taux-imposition-revenus\/revenus\/influenceurs#q3\"><strong>the tax authorities<\/strong><\/a> (page in French\/Dutch\/German). It\u2019s also worth noting that this can have significant consequences on the&nbsp;<a href=\"https:\/\/www.groeipakket.be\/en\/compensations-groeipakket\/studentwork\"><strong>family allowance<\/strong><\/a>&nbsp;payments and&nbsp;<a href=\"https:\/\/financien.belgium.be\/fr\/particuliers\/famille\/personnes_a_charge\/enfants#q7\"><strong>the tax advantage for dependent children<\/strong><\/a>&nbsp;(page in French\/Dutch\/German) that your parents receive.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Creating a sole proprietorship for your TikTok income<\/strong><\/h3>\n\n\n\n<p>When you regularly earn money via TikTok, you therefore need some form of business. Often, it\u2019s&nbsp;<strong>worth considering starting out<\/strong> <a href=\"https:\/\/www.accountable.eu\/en-be\/blog\/become-complementary-self-employed\/\"><strong>being self-employed in a secondary occupation<\/strong><\/a>&nbsp;or as a&nbsp;<a href=\"https:\/\/www.accountable.eu\/en-be\/blog\/student-and-entrepreneurial-here-is-the-right-status-for-you\/\"><strong>student entrepreneur<\/strong><\/a><strong>.<\/strong>&nbsp;If your taxable income remains below \u20ac25,000 per year, you can opt for the&nbsp;<a href=\"https:\/\/www.accountable.eu\/en-be\/blog\/vat-exemption-small-business\"><strong>VAT exemption<\/strong><\/a> scheme for small businesses, which means you won\u2019t have to charge VAT to your customers.<\/p>\n\n\n\n<p>However, you will still need&nbsp;<strong>to issue invoices.<\/strong> You\u2019ll also need to register with a&nbsp;<a href=\"https:\/\/www.accountable.eu\/en-be\/blog\/which-social-insurance-fund\/\"><strong>social insurance fund.<\/strong><\/a>&nbsp;They can help you get registered with the&nbsp;<a href=\"https:\/\/economie.fgov.be\/en\/crossroads-bank-enterprises-1\"><strong>Crossroads Bank for Enterprises<\/strong><\/a> (CBE).<\/p>\n\n\n\n<p>If you earn enough, you become&nbsp;<strong>self-employed as your main activity<\/strong>&nbsp;at a later stage. From that point on, you\u2019ll have to pay&nbsp;<strong>more social security contributions.<\/strong> And when you earn&nbsp;<strong>more than \u20ac25,000 per year<\/strong>, you&nbsp;<strong>become subject to VAT<\/strong>&nbsp;and need to charge VAT to your customers.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Creating a company for your TikTok business<\/strong><\/h3>\n\n\n\n<p>When things start going really well, it might be time to think about&nbsp;<a href=\"https:\/\/www.accountable.eu\/en-be\/blog\/sole-trader-to-company-when-how\/\"><strong>setting up a company<\/strong><\/a><strong>.<\/strong> This has the advantages of better&nbsp;<strong>covering your risks<\/strong>&nbsp;and&nbsp;<strong>optimising your salary.<\/strong> Belgian corporate tax is only 25%, whereas when you\u2019re self-employed with a sole proprietorship, you quickly reach the highest tax rate of 50%.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>How much tax do you pay as a TikToker?<\/strong><\/h3>\n\n\n\n<p>Unfortunately, there\u2019s no easy answer, as it will depend on your status and income. But here are some things to keep in mind:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A one-time payment that you declare as\u00a0<strong>miscellaneous income<\/strong>\u00a0on your income tax return is taxed at a\u00a0<strong>fixed rate of 33%.<\/strong><\/li>\n\n\n\n<li>As a student entrepreneur, you <strong>don\u2019t pay taxes<\/strong>\u00a0if your\u00a0<strong>net income remains below the tax exemption threshold of \u20ac10,160<\/strong>.<\/li>\n\n\n\n<li><strong>If you\u2019re self-employed in a secondary occupation, your TikTok income is added to your income as an employee.<\/strong> This could put you in a higher\u00a0<a href=\"https:\/\/finance.belgium.be\/en\/private-individuals\/tax-return\/tax-rates-income\/tax-rates#q1\"><strong>tax bracket<\/strong><\/a>.<\/li>\n\n\n\n<li>When you\u2019re\u00a0<strong>self-employed in a main activity<\/strong>, you pay\u00a0<strong>social security contributions.<\/strong> What remains after that is your taxable income. On this taxable income, you\u00a0<strong>pay between 25% and 50% in taxes,<\/strong> depending on how much you earn. But you have to\u00a0<strong>pay yourself a salary,<\/strong> which is subject to\u00a0<strong>income tax.<\/strong>\u00a0This salary will probably also be in one of the higher tax brackets. Fortunately,\u00a0<strong>there are tax-efficient alternatives, such as dividends.<\/strong><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Freelance TikToker?
