Terms like Bitcoin or Ethereum are not as exotic as they were a few years ago, and investing in crypto is increasingly common. But how do these digital currencies work exactly, and do you have to pay taxes on them? Find out what you need to do with cryptocurrencies in your tax return.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What are cryptocurrencies?<\/strong><\/h2>\n\n\n\n<p>You&#8217;ve probably heard of Bitcoin. That&#8217;s an example of a cryptocurrency. Cryptocurrencies or cryptocurrency are a digital and entirely virtual currency. They work with cryptographic, encrypted codes. These codes change with every transaction. Cryptocurrencies have a virtual value that can vary greatly.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Do you have to pay taxes on cryptocurrencies?<\/strong><\/h2>\n\n\n\n<p>Do you own cryptocurrencies without converting them to fiat currencies, e.g. euros, dollars, etc., or do you use crypto for buying things? <strong>Until 2025, these transactions were not subject to taxation in Belgium.<\/strong><\/p>\n\n\n\n<p>However, we have some less favourable news: <strong>in the <a href=\"https:\/\/www.accountable.eu\/en-be\/blog\/what-to-expect-from-the-new-belgian-government-as-a-self-employed-2025-update\/\">federal government agreement for 2025-2029<\/a>, announced at the end of January, it was confirmed that a general capital gains tax of 10% will be introduced. This will also apply to crypto assets.<\/strong><\/p>\n\n\n\n<p>Here\u2019s what we know so far:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A 10% tax on crypto gains will be implemented unless they fall under a professional status.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Stricter oversight of crypto transactions will be introduced: accounts must be declared to the Central Contact Point (CCP) of the National Bank of Belgium, and the tax authorities will have increased access to crypto transactions to combat fraud.<\/li>\n<\/ul>\n\n\n\n<p>\u26a0\ufe0f <strong>The capital gains tax has not yet been implemented. We will keep you informed as soon as it comes into effect.<\/strong><\/p>\n\n\n\n<p>If you are currently making profits from your crypto investments, there are 3 possible scenarios:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Scenario 1: You&#8217;re an amateur trader<\/strong><\/h3>\n\n\n\n<p>If you invest in crypto according to the principles of a \u2018prudent investor\u2019, then <strong>your digital investments are exempt from taxes<\/strong>. The tax authorities consider you an amateur. This is the case if, for example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>you invest in crypto as a hobby<\/li>\n\n\n\n<li>you make long-term investments, i.e. you buy cryptocurrencies and keep them for a long time<\/li>\n\n\n\n<li>you take few risks, for example, by spreading your investments, and not taking out loans to invest in crypto<\/li>\n<\/ul>\n\n\n\n<p><br>What if your digital coins increase in value over time? Then you don&#8217;t need to declare those value increases. You don&#8217;t have to pay VAT on crypto transactions either.<\/p>\n\n\n\n<p>\u26a0\ufe0f Warning: If you convert your cryptocurrencies into fiat currencies in this scenario, you must declare the capital gain (i.e. the difference between the purchase price and the selling price) in your tax return under <strong>\u2018miscellaneous income\u2019 and pay 33% income tax<\/strong> on it.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Scenario 2: You&#8217;re a private trader<\/strong><\/h3>\n\n\n\n<p>From the tax authorities\u2019 perspective, you&#8217;re no longer an amateur if you:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>take risks with your crypto investments<\/li>\n\n\n\n<li>regularly buy and sell and play on heavy price fluctuations<\/li>\n\n\n\n<li>want to make your investments profitable in the short term<\/li>\n<\/ul>\n\n\n\n<p><br>In those cases, the government considers you a private trader. <strong>You must then declare the crypto profits in your tax return as \u2018miscellaneous income\u2019.<\/strong> On these profits, you pay <strong>33% in income tax<\/strong> to the tax office.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Scenario 3: You&#8217;re a professional trader<\/strong><\/h3>\n\n\n\n<p>Is trading cryptocurrencies your (main) job? Then you must follow the rules for a <strong>sole proprietorship<\/strong>: you declare your crypto income in your <strong>personal income tax declaration<\/strong>. The usual progressive tax rates then apply to your annual net income, ranging between 25% and 50%. A few examples:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>For income under \u20ac15,200 per year, you pay 25% in income tax.<\/li>\n\n\n\n<li>For income over \u20ac46,440 per year, you pay 50% in income tax.<\/li>\n<\/ul>\n\n\n\n<p><br>\u26a0\ufe0f Warning: As a professional trader, you must also meet the other obligations self-employed people have, for example, joining a social security fund and paying social contributions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Tax rules around crypto are not set in stone<\/strong><\/h2>\n\n\n\n<p><strong>The above rules are not always clear-cut.<\/strong> The Belgian government looks at each case individually, taking into account the full picture. As a private trader, you\u2019re taxed at a rate of 33%, while as a professional trader, depending on whether you have a sole proprietorship or a company, you\u2019re taxed according to the progressive income tax brackets (25-50%) or corporate tax (20-25%). Note that in 2025 a capital gains tax will be introduced.<\/p> <\/div> <div class=\"schema-faq-section\" id=\"faq-question-1703145742653\"><strong class=\"schema-faq-question\"><strong>Do the Belgian tax authorities know you have crypto?<\/strong><\/strong> <p class=\"schema-faq-answer\">The tax authorities have no insight into your crypto portfolio. You can therefore own as much crypto as you want. But if you suddenly start trading a lot and make a substantial profit, the tax authorities will of course notice the increase in wealth. As a private or professional trader, you must also declare your profits from crypto to the tax authorities.
