Every self-employed individual or freelancer will have different terms and conditions&nbsp;<strong>depending on the work they do and their expectations<\/strong>. We\u2019ve listed the most common clauses below to give you a good basis for establishing your own general conditions.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Scope:<\/strong>\u00a0Indicates to which parties and to which projects or products the conditions apply.<\/li>\n\n\n\n<li><strong>Unilateral modification:<\/strong>\u00a0Allows you to modify the conditions unilaterally and at any time. This clause is especially relevant for long-term collaborations.<\/li>\n\n\n\n<li><strong>Exclusion of client terms:<\/strong>\u00a0Ensures that only your terms and conditions apply to your contract. This avoids conflicts due to contradicting conditions.<\/li>\n\n\n\n<li><strong>Quotes and orders:<\/strong>\u00a0Specifies the validity period of quotes and the conditions for cancelling orders.<\/li>\n\n\n\n<li><strong>Rates:<\/strong>\u00a0States the applicable VAT regime, the rates you charge, and how work that\u2019s not included in the quote will be invoiced.<\/li>\n\n\n\n<li><strong>Delivery and force majeure:<\/strong>\u00a0Describes the conditions and delivery times. Defines the consequences of a case of force majeure, as well as the client&#8217;s rights in the event of late delivery.<\/li>\n\n\n\n<li><strong>Retention of title:<\/strong>\u00a0Protects you as the seller of products. This clause states that the products remain the property of the seller until they\u2019ve been paid for in full.<\/li>\n\n\n\n<li><strong>Complaints and disputes:<\/strong>\u00a0Explains how to file a complaint and within what time frame. Describes the procedure the client should follow.<\/li>\n\n\n\n<li><strong>Termination and dissolution:<\/strong>\u00a0Stipulates under what circumstances the contract may be terminated and the procedure to follow.<\/li>\n\n\n\n<li><strong>Payment terms:<\/strong>\u00a0Specifies the methods of payment accepted, payment deadlines, and any down payments required. Also indicates the consequences of late payments.<\/li>\n\n\n\n<li><strong>Processing of personal data:<\/strong>\u00a0Clarifies how you store personal data and the ways in which you protect it.<\/li>\n\n\n\n<li><strong>Applicable law and competent jurisdiction:<\/strong>\u00a0Indicates which law applies and the competent jurisdiction in the event of a dispute. This will avoid you having to travel far from home in the event of a dispute.\u00a0<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Terms and conditions for online stores<\/strong><\/h3>\n\n\n\n<p>The rules on terms and conditions are&nbsp;<strong>more strict for selling to individuals<\/strong>&nbsp;(B2C) than for selling to other businesses (B2B). Do you have an online store? Then you\u2019ll need to take additional rules into account, particularly relating to&nbsp;distance selling.<strong>&nbsp;<\/strong><\/p>\n\n\n\n<p>In short, you must clearly indicate that the sale is a&nbsp;<strong>paid online order<\/strong>. The <strong>price <\/strong>and <strong>characteristics <\/strong>of the product being sold always need to be clearly stated.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>How and when to share your terms and conditions with your client<\/strong><\/h3>\n\n\n\n<p>The client must always be informed of the terms and conditions&nbsp;<strong>before concluding the contract<\/strong>.
