These apply to artists who are employees or civil servants, but also to self-employed artists. Accountable is here to guide you through the reforms, including the new \u2018attestation du travail des arts\u2019 (ATA) \/ \u2018kunstwerkattest\u2019 (KWA), or \u2018attestation of work in the arts\u2019. In this article, we explain what this attestation is, the different types that exist, and the conditions for getting one.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is an attestation of work in the arts?<\/strong><\/h2>\n\n\n\n<p>The attestation of work in the arts is an official document that\u00a0<strong>gives you the right to certain\u00a0<a href=\"https:\/\/www.accountable.eu\/en-be\/blog\/artist-grants\/\">tax benefits and subsidies for artists<\/a><\/strong>. This attestation officially confirms your status as a \u2018travailleur artistique\u2019 \/ \u2018kunstwerker\u2019, or \u2018arts worker\u2019, which allows you to automatically benefit from the social security regime for artists. This includes, for example, reduced social security contributions and special unemployment benefits for artists.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Who is the attestation of work in the arts for?<\/strong><\/h3>\n\n\n\n<p>All&nbsp;<strong>arts workers<\/strong>&nbsp;can apply for the attestation, regardless of their professional status.&nbsp;<strong>Self-employed artists in Belgium<\/strong>&nbsp;are therefore also eligible. Incidentally, the term arts worker is also new. It refers to&nbsp;<strong>anyone who does artistic work themselves<\/strong>&nbsp;and also to those who&nbsp;<strong>provide technical or artistic support to artists.<\/strong>&nbsp;<\/p>\n\n\n\n<p>This means that now, concert directors, sound technicians, casting directors and other professionals who don\u2019t do artistic work themselves can also apply for the attestation. Which makes sense, because without their contribution, the artists they work with wouldn\u2019t be able to deliver the same great results.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Types of attestation<\/strong><\/h3>\n\n\n\n<p>There are 3 different types of attestation of work in the arts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u2018Classic\u2019 attestation \u2013 valid for 5 years<\/li>\n\n\n\n<li>\u2018Plus\u2019 attestation \u2013 valid for 5 years<\/li>\n\n\n\n<li>\u2018Beginner\u2019 attestation \u2013 valid for 3 years<\/li>\n<\/ul>\n\n\n\n<p>Below, we explain the differences between these types of attestation and their advantages.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>How is this different to the \u2018artist visa\u2019?<\/strong><\/h3>\n\n\n\n<p>The attestation of work in the arts has replaced the artist visa since 1 January 2024.&nbsp;Previously, artists needed to have an artist visa to qualify for the Article 1bis regime.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Advantages of the attestation of work in the arts for arts workers&nbsp;&nbsp;<\/strong><\/h2>\n\n\n\n<p>When you apply for the attestation, you don\u2019t choose the type yourself. It\u2019s the Commission du travail des arts \/ Kunstwerkcommissie, or the Working in the arts commission \u2013 also created in 2024 \u2013 that decides which attestation you\u2019re entitled to. The Commission always assigns the attestation that\u2019s most advantageous for your particular situation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u2018Classic\u2019 attestation of work in the arts<\/strong><\/h3>\n\n\n\n<p>With the classic attestation, you pay\u00a0<strong>reduced social security contributions for eight quarters<\/strong>\u00a0if you\u2019re an arts worker who is self-employed in a primary occupation. This measure is part of the <strong><a href=\"https:\/\/www.accountable.eu\/en-be\/blog\/primostarter\/\">primostarters<\/a> <\/strong>scheme, which already existed. With the attestation of work in the arts, you no longer need a declaration of self-employment to benefit from reduced social security contributions.<\/p>\n\n\n\n<p>In addition, this attestation allows you to work under the Article 1bis regime, whereby you benefit from&nbsp;<strong>the same social protection as an employee,<\/strong> even if you\u2019re a self-employed artist without an employment contract.<\/p>\n\n\n\n<p>Finally, the attestation lets you benefit from the favourable tax regime for&nbsp;<a href=\"https:\/\/www.accountable.eu\/fr-be\/blog\/les-droits-dauteur-independants-belges\/\"><strong>copyright<\/strong><\/a>. Under this regime, your copyright income is only taxed at 15%.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u2018Plus\u2019 attestation of work in the arts<\/strong><\/h3>\n\n\n\n<p>The \u2018Plus\u2019 attestation gives you access to the same benefits as the classic attestation, but also allows you to apply for an&nbsp;<a href=\"https:\/\/www.accountable.eu\/fr-be\/blog\/allocation-du-travail-des-arts-artistes-independants\/\"><strong>arts worker allowance<\/strong><\/a>&nbsp;(formerly the artist status).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u2018Beginner\u2019 attestation of work in the arts<\/strong><\/h3>\n\n\n\n<p>The \u2018Beginner\u2019 attestation of work in the arts is identical to the \u2018Plus\u2019 attestation, but the&nbsp;<strong>conditions for getting it are more flexible<\/strong>&nbsp;for those starting out.<\/p>\n\n\n\n<p>Good to know: did you get an artist visa before 1&nbsp;January&nbsp;2024? If so, you\u2019ll automatically receive a \u2018classic\u2019 attestation of work in the arts. And if you were already entitled to an arts worker allowance, you\u2019ll automatically receive a \u2018Plus\u2019 attestation of work in the arts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Conditions for requesting an attestation of work in the arts<\/strong><\/h2>\n\n\n\n<p>To qualify for the attestation, you must be able to prove that you carry out a&nbsp;<strong>professional artistic activity.<\/strong> The Working in the arts commission has drawn up a list of activities that qualify for the attestation, including music, visual arts, choreography, and literature.<\/p>\n\n\n\n<p>Artistic activity is only considered professional if you earn&nbsp;<strong>enough professional income<\/strong>&nbsp;from it to at least partially support yourself. In addition, the time you devote to your artistic activity must constitute a significant portion of your working hours.<\/p>\n\n\n\n<p>The Working in the arts commission uses the following gross income to determine if you\u2019re eligible for an attestation:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u2018Classic\u2019 attestation of work in the arts:<\/strong> you must have a gross professional income of at least \u20ac1,000 over a reference period of two years.<\/li>\n\n\n\n<li><strong>\u2018Plus\u2019 attestation of work in the arts:<\/strong> for your first application, you must have a gross professional income of \u20ac13,546 over a reference period of 5 years or \u20ac5,418 over a reference period of 2 years. When renewing your attestation (after 5 years), the gross amounts are \u20ac4,515 over 5 years or \u20ac2,709 over 3 years, respectively.<\/li>\n\n\n\n<li><strong>\u2018Beginner\u2019 attestation of work in the arts:<\/strong> as an artist starting out, you must either have a higher education qualification achieved after following a full-time course (or other arts training), or be able to prove equivalent experience in the sector or submit a business plan in the cultural sector. You also need to prove that you have earned at least \u20ac300 gross in the last three years from artistic activities or that you have carried out at least five activities.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How to request your attestation of work in the arts<\/strong><\/h2>\n\n\n\n<p>You need to submit your application to the Working in the arts commission. This Commission is made up of representatives from the sector and delegates from the various unions, the ONEM, the INASTI and the federations of employers and self-employed workers.<\/p>\n\n\n\n<p>The Commission processes all applications via&nbsp;<a href=\"https:\/\/www.workinginthearts.be\/fr%20\"><strong>Working in the arts<\/strong><\/a>. You can register on this platform using your eID or itsme and create a dossier.
